The Regulatory Framework
The primary legal driver is Regulation 34 of the Environmental Impact Assessment Regulations, 2014 (as amended). Key requirements include:
- The holder of an environmental authorisation must ensure that compliance is audited for the full period the authorisation and EMPr remain valid
- The audit report must be prepared by an independent person with relevant expertise
- The report must provide verifiable findings on the level of performance and compliance as well as the ability of the EMPr to manage impacts
- The report must contain the information set out in Appendix 7 of the Regulations
- Audits must be conducted and submitted at the intervals specified in the environmental authorisation
- Within seven days of submission the holder must notify interested and affected parties and make the report available on request and on a publicly accessible website where one exists
Where the audit identifies insufficient mitigation or insufficient compliance the holder must submit recommendations to amend the EMPr when the audit report is submitted.
