What Environmental Consulting Covers
Environmental consulting in the South African regulatory context primarily involves guiding projects through the legal processes required to obtain and maintain the authorisations and licences needed to commence and continue activities that may impact the environment. This includes:
- Determining whether a proposed activity triggers listed activities under the EIA Regulations.
- Managing Basic Assessment or Scoping and Environmental Impact Reporting processes.
- Preparing applications for Water Use Licences or General Authorisations under the National Water Act.
- Developing Environmental Management Programmes and related management plans.
- Supporting amendments, extensions and related applications after authorisation is granted.
The goal is to obtain the necessary approvals while ensuring that environmental impacts are properly identified, assessed and managed.

Why Professional Environmental Consulting Matters
The environmental authorisation process is complex, time-sensitive and subject to strict procedural requirements.
Errors in screening, incomplete specialist studies, inadequate public participation or poorly prepared reports can result in significant delays, requests for additional information or outright refusal of the application.
Professional consulting reduces these risks by ensuring that:
- The correct assessment pathway is identified from the outset.
- All required specialist studies are scoped and completed to the necessary standard.
- Public participation is conducted in accordance with the Regulations.
- Reports meet the content requirements of the competent authority.
- Timelines are managed proactively and communication with authorities is clear.
Early engagement of an experienced consultant frequently shortens overall project timelines and reduces the likelihood of costly redesign or appeals.

Who Needs Environmental Consulting
Any organisation planning an activity that may trigger listed activities under the National Environmental Management Act or that involves a water use under Section 21 of the National Water Act will typically require professional environmental consulting support.
Common clients include:
- Property developers and construction companies.
- Mining and prospecting right holders.
- Industrial and manufacturing operators expanding or establishing facilities.
- Infrastructure developers including energy, transport and bulk services projects.
- Agricultural and commercial enterprises undertaking activities that affect water resources or vegetation.
- Public sector bodies implementing infrastructure or development programmes.
Clients of environmental consultants are typically developers, mining companies, industrial plants and infrastructure project owners who must comply with environmental laws.
In South Africa, any project listed under the NEMA regulations (for example, large developments, power plants, or significant land disturbances) will need consulting support to get an EA.
Similarly, any significant water or waste discharge or natural resource use requires expert help to navigate the National Water Act and Waste Act.
In practice, environmental consulting is essential for bridging the gap between project goals and legal requirements.

The Regulatory Framework
Environmental Authorisations are required for activities listed in the EIA Regulations published under NEMA. Listing Notice 1 activities generally require a Basic Assessment while Listing Notice 2 activities require a full Scoping and Environmental Impact Reporting process. Listing Notice 3 applies additional listed activities in specific geographic areas.
Water uses defined in Section 21 of the National Water Act require either a Water Use Licence or, where applicable, registration under a General Authorisation.
The Department of Water and Sanitation administers these applications through the e-WULAAS online system.
Both processes involve public participation, specialist input where necessary and formal decision-making by the competent authority.
Timeframes are prescribed in the Regulations but can be extended where additional information is required.
